That the special election herein provided for shall be conducted in all respects as general elections are now by law, and that in voting for or against the adoption and ratification of the pro- posed constitutional amendment, the words “For constitutional amendment,” shall be written or printed on the baloot of each elector voting. Section 4. That judges and clerks of Election shall make returns of the same to the county clerk or their respective coun- ties in the same manner and under the same penalties as they are now required by law to do in general elections. The secretary of state, on the 6th day after receiving the returns of the election from all counties of the state, shall, in the presence of the governor, the presi- dent of the senate, and the speaker of the house of representatives, open and sum up the returns and proclaim the result, and file the same away in his office; whereupon the governor shall immedi- ately issue his proclamation declaring the result, and in case it appears that the ma- jority of the electoral voting have voted “For Constitutional Amendment”, then it shall be the duty of the secretary of state to write the same on parchment, in a plain and legible hand, and attach it to the constitution of the state, which shall be filed away safely in his office, and thereupon the said proposed amendment to the constitution shall take effect as and become a part of the constitution of the state of Arkansas. Section 5. That this act shall take effect and be in force from and after its passage. OLIVER Sheriff of Pulaski county, Ark. __________ SENATOR HODGES’ REGISTRATION BILL Below we publish the registration bill of Senator Hodges, now pending in the senate. In the main the provisions are god. It would be a great improvement over the present law: AN ACT to provide for the registration of the legal voters in the state of Arkansas. SECTION 1. Be it enacted, etc. That the county clerk of each county in the state shall have exclusive authority to register the legal voters of his county, have sole custody of the registration made by him, as hereinafter provided, and, by virtue of his office as such clerk, be the registrar of his county. Section 2. That the county clerk of each county in the state, for the purpose of such registration, shall provide a well- bound book, to be kept in the office of the county clerk and ex-officio registrar, under this act, in which he shall transcribe all the names of voters in his county duly registered by the qualified registrars of election for said county in the year 1872, in the registration books of said county on file in the office of said clerk. Section 3. No clerk of any county shall have discretion or power to refuse to en- ter the name of any adult male person in said registration book applying as afore- said for registration, who will first take and subscribe the oath required by law to entitle the citizens of this state to vote, and any clerk so refusing shall pay, or his sure- ties on his official bond shall be liable to each and every applicant, for each and every such refusal, the sum of two hun- dred dollards, to be recovered by an action of debt when said applicant establishes that, at the time he was so refused, he was a qualified voter in said county, and in addition therto, upon conviction before a proper court, shall be imprisoned six months in county jail. Section 5. Any and all persons here- tofore registered, and who may hereafter register under the provisions of this act, shall be and continue qualified voters in all elections by citizens of this state as long as he shall be an continue a citizen of the county in which he is registered, without order or further application on the part of said registered voter, or other or further registration by said clerk and ex-officio registrar. Section 6. Any person who shall swear falsely, on making application to register under this act, shall be deemed guilty of willful and corrupt perjury, and, on conviction thereof, shall be pun- ished as provided by law for the punish- ment of perjury. Section 7. Each and every person, whose name shall be registered under the provisions of this act, shall be entitled to receive at the time, from said clerk and ex officio registrar, a certificate setting forth the name of the county and state, and of the applicant, and the date of such registration, sealed with the seal of said county; and, for each certificate and seal, the clerk and ex officio registrar shall be allowed a fee of ten cents, to be paid out of the county treasury. Section 8. The county clerk and ex officio registrar of each county in this state shall also provide a well bound book, in which shall be printed the oath prescribed in section five, under the head of “fran- chise.” Section 9. Each clerk and ex-officio reg- Istrar shall have power to administer the said oath to any person applying for reg- istration. Section 10. If any clerk shall violate any of the provisions of this act, or refuse or willfully neglect to perform any duty herein imposed upon him, or make any alteration in the list of voters made by him, or suffer the same to be made by any person, he shall be fined not less than one hundred nor more than five hundred dol- lars, to be recovered by indictment, and thereafter shall be disqualified to hold any office of honor, trust or profit in this state. Section 11. Whoever shall destroy or mutilate, deface, or take by violence from any clerk of the county court, or from any judges of election, or steal and take away any book of registration or list of voters required by this act to be made or kept, shall, upon conviction, be punished by imprisonment in the penitentiary not less than two nor more than five years. Section 12. That any person offering or threatening violence to any one en- gaged in the duty of registration, or dis- turbing or resisting them in any way in the performance of their duty, or who shall willfully keep away by intimidation, bribery, imposition, deceit or fraud, or see, or exert other improper or illegal in- fluences to prevent or hinder electors from going to the place of registration, or from registering, shall be deemed guilty of felony, and upon conviction thereof, be punished by imprisonment in the jail or penitentiary house of the state, for the term of not less than one, nor more than five years. Section 13. The said list no deposited with the clerk shall be subject to examin- ation as other records of said court, but no such examination by any person not officially connected with the court shall be allowed, except in the presence of said clerk or his deputy. Section 14. It shall be the duty of said clerk to make out, in well-bound books, a list of the voters so registered for each township in his county, thirty days before such election, and immediately deliver the same to the sheriff, who shall deliver them to one of the judges of election of each township in his county, five days before each election in his county. Section 15. That all acts and parts of ___ in conflict with the provisions of this not be , and the same are hereby repealed. Section 16. Also, house bill allowing equal pay to teachers in the same grade, without regard to race, color or sex, recommending it do not pass. A substitute was reported, the passage of which was recommended. The substitute was read. Mr. KENT. I would like to know whether there are discriminations made now? Mr. McVEIGH. Most certainly there are, all over the state, and even here in Little Rock. He thought no discrimination should be made between the salary of lady and gentleman teachers of equal competency in the same grade. Mr. CHAPELINE. I desire to ask the gentleman a question. Are you in favor of taxing the property of women? Mr. McVEIGH. I am in favor of the state collecting its revenue off the property of the state. Mr. SARBER. The revenue law is not under discussion. Mr. THOMASON. Are you aware of any law preventing trustees from paying ladies as much as gentleman? Mr. McVEIGH. No; but against school boards who make such discriminations. Mr. CATE. Are you in the habit of indorsing Mr. Chapeline’s bills? Mr. McVEIGH. I consider that question impertinent, and not worthy of answer. Mr. FURBUSH thought this was one of the most magnanimous bills ever introduced into the house. He was decidedly in favor of the bill. He referred to the neat and tidy lady teachers, who received lower wages than great big, overgrown, strapping Yankees, with feet as long as the moral law. Mr. J. M. Murphy. Are you sweet on school ma’ams? Mr. FURBUSH. I was nothing but a boy when I went to a lady teacher, and consequently could not have been very sweet on the teacher. Mr. ERWIN though no one was disposed to be more magnanimous to the fair sex than he was, but he thought the law allowed no discrimination at present. He thought ladies could not control boys. He said when he was a boy he was an untamable hyena; nobody could control him. Mr. CHAPELINE. We know you are a hyena now. Are you in favor of exempting the property of widows from taxation? Mr. ERWIN. Yes, and everybody else. Experience has taught me ladies cannot teach boys. He thought the best persuader was a three-year-old hickory. His boys never did anything for him for love. He had heard it discussed in debating societies which would make men go farthest, love or fear, and it was decided fear; but since he came here he found out that money would make a man go the farthest. He said boys could not be made learn unless they were well whipped. He said the thieves followed railroads, and now when $50,000 or $60,000 was stolen it was called business. Mr. KENT. What an eloquent effort! He said the better feelings of men were instilled into them by their contact with women. He said he would support the bill just as it was. Mr. SARBER. Is the gentleman from Prairie (Erwin) opposed to this bill? Mr. ERWIN. Yes. The bill was read a third time and passed—ayes 55, noes 15.
