A conductor on the Cairo and Ful- ton Arrested Charged with Violating the Civil Rights Bill. ____________________ yesterday morning a partu of colored people, Agnes Hand, Sallie Lee, Hender- son Hand, Polly Bridges and Squire Dave McWhorter, appeared at the Cairo and Fulton railroad depot, and demanded en- trance into the rear of the car. The brakeman, who had orders to distribute the passen- gers, sent the colored people to the car ahead. They refused to go, and went to the conductor, who happened to be Mr. L. R. Brown, and he refused to countermand the order. They then removed their bag- gage from the train. On the arrival of the train from Arka- delphia last night. Mr. Brown was ar- rested by Constable Garrett, (col.), who brought along another colored man to aid in the arrest, and took him before Squire McWorther, (col.), who was one of the par- ties that appeared with the others at the train but whose name was omitted from the complaint. The Squire took Mr. Brown's personal recognizance to appear at 9 o'clock this morning. As conductor, Brown has been one of the most polite of all the very polite officials of the Cairo and Fulton railroad, we know the entire community will join us in ex- pressing the opinion that in this matter he has acted not otherwise than from a severe sense of duty, and the sympathies of all right-thinking people must necessa- rily be with Mr. Conductor in this matter. Civil rights cases are becoming quite frequent, and prove lucrative to the law- yers. Yesterday afternoon another case came to notice in which an ex-justice of the peace, T.P. Johnson (col.), was concerned. It seems that policeman John Franklin, a white man, Martin Anderson, also white, and T.P. Johnson (col.) went into Nick Kupferle's lager beer saloon to get a drink. They stepped up to the bar, and the colored man asked for drinks for the party, but was refused by Henry Beuse, the bar-tender. One of the white men then offered to pay for the liquor if it would be furnished but the bar-tender still refused. It is well known that T.P.J. spoetas a lawyer's license, and this was enough for him and the case was taken into court. Mr. Beuse was ar- rested and taken before, Squire McWhor- ter, the colored justice of the peace, where he was questioned and his lan- guage not suiting the justice, he was sent to jail three days for contempt of court. We understand efforts were being made las night to effect his release, but as to their success we are not informed. The above is but one side of the story, and Mr. Beuse's statement may alter things greatly. Glassick justice of the peace at Argenta, before whom Mr. John Drees of the city was brought on a charge of violating the civil rights act, discharged defendant, as was mentioned in yester- day's paper. The reasons assigned by the justice for this are thus given: First-- That an absolute refusal did not take place. The testimony went to show that Johannessen and the negro Robin- son went into the saloon and asked for drinks, and a boy who was behind the counter asked them to step to the other side of the ice-box. The justice says it was not shown that there were one or two counters; that Johannessen called for different drinks from that of Robinson, and the justice could not tell whether whisky was sold over one counter and ber over another. They were not asked to go to another room, or out of the room, nor were they refused drinks, and consequently the justice holds that the civil rights act was not violated. Second-- No money was tendered for the drinks, an absolute requisite under the civil rights bill in order to make out the case. Last Thursday night, Senator R.A. Dawson, james R. Roland county clerk; W.H. Furbursh, member of the lower house of the general assembly and L.S. Wheeler, all colored men, went into the open-house saloon, situated on the first floor of Wood's Grand opera-house, on Mainstreet, and demanded a drink. The bar-tender, W.O. Baugh, informed them that it was against the rules of the house to give colored men drings, and that he would not do it. Senator Dawson took the case into court, no doubt proposing to make a test case out of it, and it came up before Squire Pears, yesterday, and the merits of the case were discussed before a jury by Col. Robert A. Howard, for the de- fendant, and V.M. McGebee, a white member of the senate, for the plaintiff. The witnesses in the case were R.A. Dawson, James R. Roland, W.H. Fur- bush and L.S. Wheeler all of whom ap- peared with the exception of Furbush. The following ar the names of the jurors: L.G. Berry, foreman; J.M.S. White, C. C. Fulton, Robert Lace (col.), George Cham (col.), Charles Scott (col.), who after duly considering the case, brought in a veridict as follows: Little Rock, April 14, 1873. We, the jury in the case of the People vs. William C. Baugh, for violation of the fourth section of the civil rights act of the state of Arkansas, find the defendant guilty, and assess the fine of $25. L.G.Berry, Foreman. After the veridic was given, Col. How- ard gave notice of appeal, and the case will be taken to the criminal court. 'Squire Pears little office was crowded with colored people during the trial, among whom were a few whites. When any inn or hotel- keeper shall refuse lodging, accommoda- tion or entertainment to any person or persons, equal to first-class accommoda- tions, for any other reason, cause or excuse than such as are known as valid, good and sufficient in and by the common law, upon such person or persons applying and first offering to pay a sum equal to first-class hotel fare or accommodations, such inn, or hotel-keeper or agent, for every such offense, refusal,denial, or re- jection, shall be deemed guilty of a high misdemeanor. Section 3. When any person or per- sons are acting in the capacity or business of keeping places of entertainment for public amusement, shall refuse any per- son or persons admission to seats equal to first-class seats, in and to the same, for any other reason, excuse or cause than such as are known good and valid and sufficient in and by the common law, upon such person or persons first tender- ing the amount equal to the price of first- class seats, fare or tickets, such owners or agents so keeping places of entertainment for public amusements, for every such of- fense, denial or rejection, shall be deemed guilty of a high misdemeanor. Section 4. That when any person or persons, agents, conductors or drivers, who shall be found guilty by indictment before the grand jury of the county where such offense, refusal, rejection or misdemeanor occurs, shall, on trial and conviction of the charge of high misde- meanor, as provided in the three preced- ing sections, be fined in a sum not less than two hundred nor more than five thousand dollars, at the discretion of the jury trying the case, or be imprisoned in the county jail not exceeding twelve months. Section 5. Be it further enacted, That nothing in this [act] bill shall be so con- strued as to prevent any person or per- sons from bringing a civil suit against any of the above named parties for damages. The republican party, in submitting this amendment to the people, have re- deemed one of the pledges of their plat- form to the letter. We hope it will in the same spirit carry out its promises to the proper end- the ratification of the amendment- as it is alike just to the peo- ple and an honor to the party. We hope, too, that the other pledges of the August platform will be likewise redeemed, and then we may look for the better day in Arkansas- the day of good feeling be- tween men and races- the day of honest and impartial government, and of genuine material prosperity. Give the d-l his due: let who may bring about, we bid them God speed. Voters will remember to vote “FOR CONSTITUTIONAL AMENDMENT.” Any other formula might give a pretext for throwing out the ballot. Put on your ticket the words, “FOR CONSTITUTIONAL AMENDMENT,” and no others. We append the law: SECTION 1. Be it enacted, etc., That ten days after passage of this act the governor shall issue his proclamation, calling a special election to be held on the third day of March, 1873, at the usual voting places throughout the state, for the pur- pose of submitting the proposed amend- ment to the constitution- which, if adopted and ratified in the manner prescribed by article 12, shall thereafter be substituted for and known as article 8 of the consti- tutiono of the state of Arkansas- of the people for their ratification or rejection, which proclamation, together with the proposed constitutional amendment shall be published in the official journal of the state from the time said proclamation should be issued until the day of election. Section 2.
